Smoking outdoors is banned in Victoria

From August 1, smoking will be banned in all outdoor dining areas in Victoria where food is available.

The ban comes after the Victorian Parliament passed the Tobacco Amendment Act 2016 on 13 October last year.

The new laws cover all outdoor dining areas where food, other than pre-packaged food or uncut fruit, is provided on a commercial basis. This applies to all outdoor dining areas at restaurants, cafes, take-away shops and licenced premises.

The ban does not extend to outdoor drinking areas.

The Victorian government says the smoke free areas protect the community from exposure to second-hand tobacco smoke, would make smoking in the community less acceptable so that the less smoking people see in public places, the less likely they would think it is okay, rather than harmful and they would also support people who have quit or are trying to quit smoking.

Local councils might also have the power to introduce local laws in their own jurisdictions prohibiting smoking in outdoor drinking areas. 

Because the new rules might be confusing for many cafes and restaurants, Manningham City Council held information sessions this week on July 24.

Manningham City Council Mayor Cr Michelle Kleinert said the information sessions would help businesses manage the transition.

She said the Andrews government’s ban would allow Victorians to enjoy a meal outside without being subjected to second-hand smoke.  

“This ban will cover all outdoor dining areas at restaurants, cafes, take away shops and licenced premises,” Cr Kleinert said.

“It also covers food fairs and within 10 metres of food stalls and vendors at organised community events.

“It’s important businesses are well informed and sufficiently prepared for these changes.

“Council is actively working with businesses to help them understand their obligations under the new laws.”

The bans are enforced by local councils.

Individuals and businesses can face on-the-spot fines up to $793 for non-compliance.
