Luv-a-Duck ACCC stoush returns to court

The western Victorian based poultry company Luv-a-Duck is back in the Federal Court this morning, as it fights the consumer watchdog's allegations it engaged in deceptive conduct through the promotion of its products.

The Australian Competition and Consumer Commission (ACCC) alleges Luv-a-Duck misled customers by claiming its products were made from ducks that were "grown and grain fed in the spacious Wimmera wheatlands" when they had no access to the outdoors.

It first took action against the Nhill-based company in March but Luv-a-Duck rejected the claims, arguing it stopped using the alleged offending statements last year.

Luv-a-Duck says it will fight the ACCC's claims.

The case will return to the Federal Court in Melbourne for scheduling conference this morning with Justice Jennifer Davies.

The parties will then return to court for a five-day trial in October.

On Monday, the Federal Court is also due to hand down its ruling over a similar case for the Griffith-based Baiada Poultry.
